Data Processing Agreement

This Data Processing Agreement ("Agreement") is entered into by OuiKreate and the User of OuiKreate.com ("User") as of the date the User agreed to the OuiKreate.com Terms and Conditions ("Effective Date").

1. Definitions

In this Agreement, the following terms shall have the following meanings:

• "Data Protection Legislation" means all applicable privacy and data protection laws including the General Data Protection Regulation (GDPR).
• "Personal Data" means any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier.
• "Services" means any service provided by OuiKreate to the User.

2. Data Processing

OuiKreate agrees to only process Personal Data on behalf of and in accordance with the User's instructions for the following purposes:

• Provision and maintenance of the Services;
• Processing initiated by Users in their use of the Services;
• Processing to comply with other reasonable instructions provided by User (e.g., de-identifying Personal Data).

3. Rights and Obligations of the User

The User represents and warrants that it has complied and will continue to comply with all applicable laws, including Data Protection Legislation, in respect of its processing of Personal Data and any processing instructions it issues to OuiKreate.

4. Confidentiality and Security

OuiKreate ensures to take all measures required pursuant to Article 32 of the GDPR to keep the Personal Data secure.

5. Subprocessors

OuiKreate may engage Subprocessors to process Personal Data on behalf of the User. In such case, OuiKreate will enter into a written agreement with the Subprocessor.

6. Changes to this Agreement

OuiKreate reserves the right to update and change this Agreement from time to time. We will notify the User of any changes by posting the new Agreement on this page.
